Estate Planning, Wills & Trusts

We assist our clients in developing estate plans that achieve their objectives for transferring their wealth and facilitating family harmony. We work with our clients to fulfill these family objectives through the use of partnerships, trusts, charitable foundations and other charitable vehicles to maximize the amount received by their beneficiaries and designated charities while minimizing tax liabilities and the expenses of administration.

Implementation of these plans includes the drafting of various legal documents such as Wills, and various tax saving trusts including Credit Shelter Trusts, Marital Deduction Trusts, Irrevocable Life Insurance Trusts and Charitable Trusts. Revocable Living Trusts are sometimes used as an alternative to wills for the disposition of assets and in the case of incapacity. As part of our estate planning review, we encourage clients to plan for the unexpected by considering Incapacity Planning where General Powers of Attorney and the Georgia Advance Directive for Health Care are useful instruments to have in place.

Probate & Estate Administration

Careful estate and tax planning during a person's life bring benefit and comfort to his or her family and beneficiaries when he or she dies. When a person dies, we assist his or her family, beneficiaries, heirs or personal representative (also known as an executor) with probating the will, obtaining letters testamentary and administering the estate. As part of that administration, we can assist in transferring title to real estate, securities and other assets. We also work with trustees to administer trusts. As with the estate planning, we work to facilitate family harmony during the probate and administration phase of the process.

Sometimes, there is a probate controversy that involves family members or personal representatives; settlement agreements, court ordered mediation or arbitration can resolve such disputes. If there is a dispute involving a personal representative, we can assist in resolving that dispute. In disputes with the IRS, we pride ourselves on our effective advocacy for our clients.

We are experienced in postmortem tax planning. Due to our Tax Planning, Tax Return Preparation service and expertise in Estate Administration, we are highly skilled in preparing estate tax returns, estate income tax returns, trust income tax returns and gift tax returns.
